- Schools and institutions are responsible for accounts created under their organization.

3. Acceptable Use Policy
You agree not to:
- Use Spark-ED for unlawful, fraudulent, or harmful activities
- Attempt unauthorized access to systems, data, or accounts
- Upload malicious code, malware, or viruses
- Violate student privacy, data protection laws, or intellectual property rights
- Reverse engineer, copy, or resell the platform without authorization
We reserve the right to suspend or terminate accounts that violate these rules.
4. Data Privacy & Security
- Spark-ED handles sensitive educational and personal data.
- We follow applicable data protection regulations (including PDPL, GDPR where applicable).
- Schools remain the data owners of their institutional data.
- Our handling of personal data is governed by our Privacy Policy, which forms part of these Terms.
5. Subscription Plans & Payments
- Some features require a paid subscription.
- Fees, billing cycles, and included services are displayed on the website or in agreements.
- Payments are non-refundable unless explicitly stated.
- We may update pricing with prior notice.
Failure to pay may result in service suspension.
6. Intellectual Property Rights
- Spark-ED, its software, design, trademarks, logos, and content are our exclusive intellectual property.
- Schools retain ownership of their uploaded content and data.
- You grant Spark-ED a limited license to host and process data solely to provide the Services.
7. Third-Party Services & Integrations
Spark-ED may integrate with third-party services (e.g., payment gateways, email, analytics, AI tools).
We are not responsible for third-party services, their availability, or their policies.
8. Service Availability & Updates
- We strive for high availability but do not guarantee uninterrupted service.
- Planned maintenance or updates may cause temporary downtime.
- Features may evolve, be added, or discontinued to improve the platform.
9. Artificial Intelligence Features
Some features may use AI for analytics, recommendations, or automation.
- AI outputs are assistance tools, not final decisions.
- Schools remain responsible for academic, disciplinary, and administrative decisions.
- AI results should be reviewed by qualified staff before action.
10. Termination
We may suspend or terminate access if:
- These Terms are violated
- Required by law or regulation
- Non-payment occurs
Upon termination:
- Access to the system may be revoked
- Data export options may be provided upon request (subject to agreement)
11. Limitation of Liability
To the maximum extent permitted by law:
- Spark-ED is provided “as is” and “as available”
- We are not liable for indirect, incidental, or consequential damages
- Our total liability shall not exceed the fees paid in the preceding 12 months
12. Indemnification
You agree to indemnify and hold Spark-ED harmless from claims, damages, or losses arising from:
- Misuse of the Services
- Violation of laws or regulations
- Breach of these Terms
13. Governing Law
These Terms are governed by the laws of the Kingdom of Saudi Arabia, unless otherwise agreed in writing.
